Carefinder Terms and Conditions

Carefinder is a platform owned by Stories.space B.V., located at the Emmaplein 7A, 1075 AW Amsterdam, registered in the Trade Register of the Chamber of Commerce under number 76591824.
Carefinder publishes profiles of healthcare professionals. Carefinder initially compiles these profiles based on information from public sources (such as Zorgweb). Every healthcare professional can (a) have their profile removed or (b) 'claim' it. If you claim your profile, you can choose between (a) a regular profile and (b) a premium profile. In both cases, these Terms and Conditions apply to your use of Carefinder. Depending on whether you choose regular or premium, some provisions of these Terms and Conditions may or may not apply.
1. Applicability
1.1These Terms and Conditions apply to your use of Carefinder. By claiming your profile on Carefinder, you agree to the applicability of these Terms and Conditions. If you do not agree with the content of these Terms and Conditions, you may not use Carefinder.
1.2If you also purchase other services or products from Stories.space B.V., different terms and conditions apply to such other services or products. These Terms and Conditions only apply to your use of the Carefinder platform.
1.3Any general terms and conditions that you yourself use are expressly rejected and do not apply to your use of Carefinder.
2. Regular Profile or Premium Profile
2.1Once you have claimed your profile on Carefinder, you have subscribed to a 'regular profile' which you can customize.
2.2Carefinder also offers 'premium profiles' that have more options for customization. More information about the current options for the premium profile will be shared at the moment of signup for a premium profile. Carefinder has no obligation to make you an offering for a premium profile.
2.3After your application for a premium profile has been granted, you will take out a subscription with us. The initial term of this subscription is 12 (twelve) months, unless we agree otherwise in writing or electronically. After the first term of your subscription, your subscription will be renewed for an indefinite period. You can then cancel your subscription at any time, subject to a notice period of 30 (thirty) days.
2.4If you take out a subscription with us, you have fourteen days from the date on which you enter into the Agreement to terminate the agreement without having to give any reason. You can exercise your right of termination by sending a clear email to the email address mentioned in Article 11. We will confirm receipt of your notice of termination as soon as possible.
2.5If you opt for a regular profile, you can stop using Carefinder at any time. You do not need to notify us of this.
3. Premium Profile Costs and Payment Terms
3.1There are costs associated with the premium profile. Pricing and subscription details will be shared with you at the moment of signup for a premium profile.
3.2After (i) the trial period (fourteen days after the start date of your Agreement) and (ii) the premium profile content (video and photographs) have been added to your profile, you are obliged to pay the price that applies to your subscription.
3.3Please be aware that you may incur (additional) costs for using electronic means of communication, regardless of your subscription (regular or premium). These costs depend on the subscription you have with your provider. For example, if you use Carefinder via the mobile network, you may be charged for data usage.
3.4Payment is due monthly, in advance. We will debit the amount owed by you from your account by means of a direct debit. If the direct debit fails or is unsuccessful for any reason, we will send you a notification to remind you of your payment obligation.
3.5You must pay your subscription fees within 14 (fourteen) days from the due date. If you fail to do so, we have the right to suspend the Services immediately. This means that you will not be able to use the Services until you have fulfilled your payment obligations. Please be aware that if we suspend your subscription, your subscription will continue and your payment obligations will therefore also continue. If you no longer wish to have any payment obligations, you must cancel your subscription as soon as possible. This is at the earliest at the end of the first term. If your payment is still outstanding after we have sent you a reminder, we also have the option of terminating your subscription by cancellation or dissolution with immediate effect.
3.6If you do not pay our invoices or do not pay them on time, and you still do not pay within fourteen days of receiving a reminder from us, we have the right to charge you the statutory interest and collection costs. We will charge the maximum interest and costs permitted by law.
3.7We may increase the prices for our subscriptions each year on January 1 based on the consumer price index of Statistics Netherlands (CBS). If you have taken out an annual subscription, we will not increase the price during the first term of your annual subscription.
3.8Once the initial term of your subscription has expired, we may increase the prices of our subscriptions at other times of the year. In that case, you have the right to cancel your subscription. You can cancel your subscription in such a case by sending an email to the email address mentioned in Article 11 and you must then observe a notice period of 30 (thirty) days. Prices will not be increased during your notice period.
4. Stopping the Use of Carefinder
4.1Regardless of the type of profile you have chosen, you can stop using Carefinder at any time. Please note that if you have a premium subscription, stopping using Carefinder does not automatically terminate your premium subscription. You can read how to cancel a premium subscription in Article 2 of these Terms and Conditions.
4.2If you do not or no longer want to use Carefinder, you can choose to delete your profile completely or keep your regular profile but hide it from Carefinder (make it invisible for visitors of our website). You can make these amendments yourself using the option provided in your profile. For assistance you can contact us at the email address mentioned in Article 11.
4.3 Because profiles on Carefinder are automatically generated from public sources, we provide you with two options if you desire to delete your profile (instead of keeping a regular profile which may be hidden): (a) your profile can be deleted but we retain your AGB code, or (b) your profile can be deleted and we also delete your AGB code from our systems. If you choose option (b) it is possible that after you have deleted your profile, a new profile of you may reappear on Carefinder after some time because your profile was automatically generated from a public source again.
5. Fair Use
5.1You may not use Carefinder for:
the storage of data or documents that infringe on the rights of others for any reason, such as privacy rights, the right to honor and reputation, and intellectual property rights of others;
hacking, spreading spam, phishing, or viruses, and/or other activities that infringe on our cybersecurity or that of others;
copying, modifying, counterfeiting, distributing, or reselling our services or parts thereof.
5.2If you do not comply with these rules for fair use of Carefinder, we have the right to immediately suspend our services to you and to recover from you any damage we suffer and costs we incur as a result of your actions.
6. Intellectual Property
6.1 Our services and the content on Carefinder (including the content in your profile) may be subject to intellectual property rights. These rights belong to us or our licensors. The use of Carefinder does not transfer any intellectual property rights to you. Intellectual property rights that belong to you are also not transferred to us through the use of Carefinder.
6.2All information we provide to you on our website and in the performance of our services is intended for personal use. Without our prior written consent, you are not permitted to reproduce (copy), transmit, or make available to others the information we provide. This means, among other things, that you may not share the information with others in such a way that those others can actually use our services (or part thereof) without having to take out a subscription with us themselves.
6.3The trade name and the Carefinder word and figurative mark are our property. You are not permitted to use this trade name and mark without our written permission.
7. Content
7.1 We do not guarantee that all information included in your profile is correct and/or up to date at all times. You can check this yourself and make changes if necessary. If, for any reason, you are unable to correct incorrect or outdated information yourself, please contact us at the email address mentioned in Article 11.
7.2If you take out a premium subscription with us, we may offer to create special content for your profile, such as (professional) photos and videos. We grant you a right of use for this content for the duration of your subscription. This means that you may no longer use this content after your subscription has expired.
8. Guarantees
8.1We cannot guarantee that our services will lead to a specific result. Nor can we guarantee that our services will always be available without interruption, partly because we depend on the services of third parties for this. However, we do guarantee that, within the package of services you purchase from us, we will make every effort to keep our services available as much as possible.
8.2We do not guarantee that our services, and in particular the Carefinder platform, are error-free. If errors are found or occur in the services and these errors prevent normal use of the services, we will endeavor to remedy them as quickly as possible. We therefore reserve the right to use temporary workarounds.
9. Liability and Interim Termination
9.1Our liability for damage you suffer as a result of or in connection with the use of our services is limited as set out in this Article. This is only different in the following cases:
your damage is caused by intent or gross negligence on the part of our management;
our obligation to pay compensation cannot be excluded on the basis of mandatory law, but only to the extent that it cannot be excluded.
9.2We are not liable for any indirect damage suffered by you, such as lost income, lost turnover, damage to reputation, or reduction in goodwill.
9.3If we fail to properly fulfill important obligations under the agreement and this is attributable to us, or if you suffer damage for any other reason due to our actions, you are entitled to a maximum of a refund of the amounts you have paid to us for the use of Carefinder in the three months prior to the moment we failed to fulfill our obligations under the agreement.
9.4We will only be in default if you:
have given us written notice of default. You can do this by sending a clear email to the email address mentioned in Article 11; and
have given us a period of 30 (thirty) days in that notice of default to still fulfill our obligations; and
we have not fulfilled our obligations within the given period of 30 (thirty) days.
9.5If you have completed the steps in Article 9.4 and we have still not fulfilled our obligations, you also have the right to terminate the agreement. You can do this by confirming this in writing to us via the email address mentioned in Article 11.
9.6Articles 9.4 and 9.5 do not apply if the obligation(s) we fail to fulfill are, in all reasonableness, of minor importance compared to the obligations we do fulfill.
10. Amendment of These General Terms and Conditions
10.1We reserve the right to amend these General Terms and Conditions from time to time. In that case, we will notify you of our new General Terms and Conditions. These new General Terms and Conditions will automatically apply to your subscription from the effective date of the new General Terms and Conditions.
10.2If you do not agree with the new Terms and Conditions and the new Terms and Conditions constitute a material change to your subscription to your disadvantage, you can cancel your subscription with us if you have a premium subscription. You can do this by sending an email to the email address mentioned in Article 11 and you must then observe a notice period of 30 (thirty) days. During this notice period, the old Terms and Conditions will continue to apply.
10.3If you have a regular subscription, you can stop using Carefinder at any time.

12. Applicable Law and Disputes
12.1Dutch law applies to your subscription and these Terms and Conditions.
12.2If a dispute arises between you and us, you can initially submit a complaint via the email address or phone number mentioned in Article 11.
12.3Disputes that we cannot resolve through mutual consultation will be submitted to the court in the district where you reside.
